Biography
Diane L. Drain, attorney-at-law, counselor and an Arizona native, founded the Law Office of D.L. Drain, P.A. in 1990 after leaving a large firm. She is licensed in the State of Arizona, the United States District Court of Arizona and the United States Court of Appeals for the Ninth Circuit. She focuses creditor and debtor bankruptcy rights, real estate workout, foreclosure and trustee's sales. Prior to law school Diane spent 15 years working as a paralegal and law office administrator. She also is a mentor for other lawyers setting up their own law firm.
Philosophy: Diane is a conservative and practical advocate for her clients. As a well known Phoenix bankruptcy attorney, Diane truly believes that “when you find your passion, going to work every day is a joy, not a job.” Her clients and fellow lawyers can attest to her passion and commitment to excellence. “Our reputation is built on our client’s trust that we could help them during a very difficult time. Our commitment to each client is to provide them the best guidance we can.” (comments from our clients available at our web site.)
Why Do I Concentrate on Bankruptcy: That’s simple – it is the only area of law that reminds me of why I went to law school – to help others in their time of need. As a law professor I told my students that I am fascinated by how bankruptcy laws resemble magic. When a bankruptcy is filed a “magical” umbrella, called the automatic stay, protects the debtor and their property. This umbrella is so powerful that it stops almost everyone in their tracks – even the IRS. Unless a court orders otherwise a mortgage company, bill collector, or creditor cannot meddle with the debtor or any property of the debtor. Of course, this does not mean the individual filing bankruptcy is able to keep their house or car without paying the secured creditors. Warning: bankruptcy is complicated and must be treated with respect. Many people file their own bankruptcy or hire inexperienced or unscrupulous attorneys. This can be the beginning of a nightmare. They lose their tax refunds, vehicles, inheritance and certain property that is important to them. Normally this can be avoided if a bankruptcy is planned properly and if time allows.
